State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judgment lacking its fundamental constituents. Effect: its nonexistence. Cases thereof. A defect that does not constitute grounds for that. Its sanction is nullity, not nonexistence. The defects affecting it may not be examined except by seeking redress through the appropriate avenues of challenge. - A judgment rendered by a court having jurisdiction and becoming final and unchallengeable. Its res judicata effect may not be disregarded on the basis of its nullity for contravening a rule of public policy. Reason thereof.
