English translation of the principle

The court may, at the request of a litigant or of its own motion, correct purely clerical errors occurring in its judgment. - A clerical error is one occurring in expression, not in reasoning, and must have a basis in the contents of the judgment itself indicating the correct facts as viewed by the judgment, such that this error is plainly apparent merely from comparing the clerical error appearing in the judgment. The reason for this. So that correction does not become a pretext for retracting the judgment or impairing its res judicata effect. - An application to correct a clerical error in a judgment. No particular form is required, nor is service upon the opposing litigant or summoning that litigant to appear required; it may be submitted through the ordinary procedures for instituting an action. The judgment’s contravention of this - 378 - Civil Procedure and its requiring, for correction of the judgment, recourse to the procedure under Article 124 of the Civil Procedure Law rather than the ordinary procedures for instituting an action. A contravention of the law and an error in its application requiring its cassation.
