Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2405

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Enforcement of judgments is a judicial procedure. Its condition: directing enforcement against the judgment debtor and verifying the identity of the person against whom enforcement is undertaken. This falls upon the applicant for enforcement; otherwise, compensation must be paid to the injured party for the damage suffered by the person against whom enforcement is undertaken if it transpires that he is not the judgment debtor.
