State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The rule is that only the person bringing a challenge to a judgment benefits from it, and it may be invoked only against the person against whom it was brought. - Failure of some judgment debtors to challenge the judgment. Has no effect on a challenge validly brought by others. The reason for that. The legislature’s departure from this rule in three cases. Article 134/2 of the Law of Civil Procedure, including indivisibility. Its meaning. A person who missed the time limit for challenging the judgment or accepted it has the right to challenge it while a challenge brought by one of them is being heard, joining him in his claims. His failure to do so. The court may order his joinder in the challenge. The rationale for that. And its effect. - An appeal by one of the judgment debtors and the court’s order joining the remaining heirs—the appellants. The effect of that. Another appeal brought by one of them. A ruling that the appeal may not be heard because it has previously been adjudicated. Correct.
