State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The agency provisions stipulated in the Civil Code. Their application to the relationship between a lawyer and his client in matters for which no provision exists in the Law Regulating the Legal Profession. - Agency is a revocable contract. Implication thereof. The principal may dismiss his agent at any time or restrict his agency, even if it is fixed for a specified term, unless the agency is in the agent's interest. This concerns public policy, and no agreement to the contrary is permissible. The principal incurs no liability therefor unless he dismissed his agent without reasonable justification or at an inappropriate time. The judgment's contravention thereof and its treatment of agency as an irrevocable contract where a duration has been agreed, such that the agent may not be dismissed before its expiry. Renders it defective and necessitates its cassation.
