Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3263

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The deceased's car approaching at speed without caution, passing the traffic signal, and the insured car approaching the same intersection from another direction and striking the first car violently, causing the deceased injuries that took his life. The movement of the insured car is itself the damaging act directly performed by its driver, who is therefore deemed the direct perpetrator of the harm even if he was not at fault. The deceased's act, however, is a circumstance that prepared the way for his death, that is, for the harm, so long as there is no ground relieving the direct perpetrator of liability, namely, the injured party's intentional infliction of injury upon himself or the occurrence of the harm as a result of intentional gross misconduct on his part.
