English translation of the principle

The general rule is that a cheque is an instrument for paying a debt to the person in whose favour it is drawn or to whom it has passed, and its delivery to the beneficiary is a presumption thereof until the contrary is proved. The implication thereof. It is not, by itself, sufficient to establish that the beneficiary owes its value to the drawer, and the creditor's mere acceptance of it does not constitute payment discharging the debtor.
