Kuwait Court of Cassation principle number 4010

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A fixed-term contract. Its condition: that the future event certain to occur, upon which the contract ends, be precisely defined so as to eliminate uncertainty. - Concluding a contract for a specified term and agreeing therein that it may be renewed for similar terms without specifying the number of renewals. It is regarded from its inception as an indefinite-term contract. The reason: the future event upon which the contract will end, the occurrence of which does not depend on the will of either party, was not defined so as to eliminate uncertainty, making it impossible to ascertain the time the contracting parties designated for the contract to end. Example.
