English translation of the principle
Notice before termination of an indefinite-term employment contract. The party terminating the contract may substitute for it payment to the other party of pay in lieu of notice. Article 17 of Law 28 of 1969. There is no scope for applying the provisions of the Private Labour Law, the Labour Law in the Private Sector, concerning the gratuity where notice is not given before termination. The rationale thereof.

الإعلان قبل فسخ عقد العمل غير محدد المدة. جواز استعاضة الطرف الذي فسخ العقد عنه بأن يؤدي للطرف الآخر بدل الإعلان. م١٧ ق ٢٨ لسنة ١٩٦٩. لا محل لأعمال أحكام قانون العمل الأهلي قانون العمل في القطاع الأهلي في صدد المكافأة عند عدم الإعلان قبل الفسخ. علة ذلك.Original Arabic judgment citations
