English translation of the principle

Establishing or negating the occurrence of the injury during and because of work is a question of fact which the trial court independently assesses, so long as its assessment is reasonable. - Considering an injury a work injury during the worker’s journey to or from work. Its condition: that he has not deviated from the normal route when going or returning. Argument on factual matters. Impermissible before the Court of Cassation. An example. - The appellant’s acceptance of the first-instance judgment insofar as it ruled in her original action that the first respondent alone must pay compensation, and its becoming final in respect of her. It is impermissible to reassert that the second respondent is jointly and severally liable with the first to pay her entitlements pursuant to the condition of the insurance policy concluded between them. The challenge to it in this regard. Inadmissible.
