Article 1005 of Civil Code

1 - The third-party possessor, if he was not a party to the action in which judgment was rendered against the debtor, may invoke the defenses that the debtor could have invoked if the judgment postdates the establishment of his status Law Index 1075 Home Page Civil Code Decree-Law No. 67 of 1980 AD Promulgating the Civil Code as third-party possessor. 2 - The third-party possessor may in all cases invoke the defenses that the debtor still has the right to invoke after judgment.
