Article 1012 of Civil Code

1 - Every creditor whose right is entered and every surety for an entered right may request the sale of the property sought to be purged of encumbrances, within thirty days of the last formal notice. 2 - The request shall be made by notice addressed to the possessor and the previous owner. The applicant must deposit with the treasury of the Enforcement Department an amount sufficient to cover the expenses of sale by auction. He may not recover the amount expended on expenses if the auction does not result in a sale at a price higher than the amount offered by the possessor. The request shall be void if these conditions are not fulfilled. 3 - The applicant may not withdraw his request except with the consent of all registered creditors and all sureties.
