Article 1077 of Civil Code

English translation

1 - Amounts owed by a guest to a hotel proprietor for accommodation, provisions, and expenditure on his account shall have a privilege over the effects brought by the guest into the hotel or its appurtenances. 2 - The privilege attaches to the effects even if they do not belong to the guest, unless it is established that the hotel proprietor knew, when they were brought into his premises, of a third party's right over them, provided that those effects are not stolen or lost. The hotel proprietor may oppose removal of the effects from his hotel so long as his claim has not been satisfied in full. If the effects are removed despite his objection or without his knowledge, the privilege shall remain attached to them, without prejudice to rights acquired by third parties in good faith in the manner specified in Article 1076 concerning the privilege of the lessor of immovable property. 3 - The hotel proprietor's privilege has the same rank as the lessor's privilege. If the two rights compete, the earlier in date shall take priority, unless it is ineffective against the other.
