Article 191 of Civil Code

1 - If a contract is void or annulled, and the essential elements necessary for another contract can be derived from it, that other contract shall come into existence. 2 - Consent to the contract into which conversion takes place shall be deemed to exist if it appears that the contracting parties would have intended it had they known of the invalidity of the contract they originally intended to conclude.
