Article 204 of Civil Code

English translation

1 - If a person undertakes towards another to cause a third party to assume an obligation towards that other person concerning a specified matter, he, and not that third party, shall be bound by his undertaking. - If the third party refuses to assume the obligation undertaken, the promisor shall be in breach of his undertaking and must compensate the promisee for any harm he suffers because of the breach, unless the promisor offers to perform the matter undertaken himself and is able to do so without harm to the promisee. - If the third party accepts the obligation, he shall assume it and the promisor shall be discharged. He shall assume it from the time of his consent unless it appears that he intended the effect of that consent to relate back to the time the undertaking was made. 2 - Stipulation for the Benefit of a Third Party
