1 - A stipulation for the benefit of a third party shall establish for the beneficiary a personal right against the promisor, which he may enforce directly against him, unless otherwise agreed and subject to the provisions of the following Article. 2 - The stipulator may demand that the promisor perform the right stipulated for the beneficiary, unless it appears from the contract that this is reserved exclusively to the beneficiary.

١ - يترتب على الاشتراط لمصلحة الغير أن يثبت للمستفيد، في ذمة المتعهد، حق
شخصي له، يكون له أن يستأديه منه مباشرة، وذلك ما لم يتفق على خلافه،
ومع مراعاة ما تقضي به المادة التالية.
٢ - ويجوز للمشترط أن يطالب المتعهد بأداء الحق المشترط للمستفيد، ما لم يتبين
