English translation
1 - In contracts binding on both parties, if one contracting party fails to perform his obligation when it falls due, and after he has been formally put in default, the other contracting party may, if he does not prefer to uphold the contract, request the judge to rescind it, with compensation where warranted, unless the party seeking rescission is himself in default in performing his obligations. 2 - When rescission is requested, the judge may grant the debtor a period of grace which he determines, if the circumstances so require. He may also refuse rescission if the debtor's unperformed obligation is slight in relation to his obligations as a whole.
