Article 210 of Civil Code

1 - A term deeming the contract rescinded automatically without a court judgment, or a term restricting the court's authority with respect to rescission of the contract, shall not be given effect unless it is clear that both contracting parties expressly intended it, with awareness of its true effect. 2 - A term providing for automatic rescission of the contract upon failure to perform an obligation does not, in non-commercial matters, dispense with formal notice of default, even if exemption from it has been agreed.
