Article 404 of Civil Code

1 - If the debtor makes an actual tender of the debt and follows the tender with a deposit or an alternative procedure, he may withdraw that tender so long as the creditor has not accepted it, or so long as no final judgment has been issued declaring it valid. If he withdraws, the debt shall remain as it was, together with its guarantees. -2 However, if the debtor withdraws the tender after the creditor has accepted it, or after a final judgment has declared it valid and the creditor accepts that withdrawal from him, the creditor may not thereafter invoke the securities that secured his right, and the co-debtors and guarantors shall be discharged.
