إذا لم يتوافر في المأجور وقت التسليم الصفات التي كفل المؤجر للمستأجر وجودها
فيه ، كان للمستأجر أن يطلب فسخ الإيجار أو إنقاص الأجرة وذلك دون إخلال
بحقه في التعويض إن كان له مقتض .
