English translation
If the person contracting with the representative is not obliged to regard the contract as concluded between himself and the principal, and does not accept it as such, the contract shall be deemed concluded between himself and the representative personally, without the representative being entitled to invoke his intention to contract in the principal's name.

إذا لم يكن المتعاقد مع النائب مجبرا على اعتبار التعاقد حاصلا بينه وبين الأصيل,
ولم يرتضه, اعتبر التعاقد حاصلا بينه وبين النائب شخصيا، دون أن يكون للنائب
