Article 602 of Civil Code

1 - In the case of subletting, the relationship between the original lessee and the lessor remains subject to the provisions of the contract concluded between them. The relationship between the original lessee and his sublessee shall be governed by the provisions of the sublease. - Nevertheless, the sublessee must pay the lessor directly whatever he owes the original lessee at the time the lessor serves him with formal notice to that effect. He may not invoke against the lessor any rent he has paid in advance to the original lessee, unless Index of the Law 1021 Home Page Civil Code Decree-Law No. 67 of 1980 AD Promulgating the Civil Code that payment was made before the formal notice and under an instrument bearing an established date.
