The original lessee shall be discharged vis-à-vis the lessor, whether as regards guaranteeing the assignee in the case of assignment of the lease or as regards the obligations imposed by the original lease in the case of subletting, if the lessor expressly or impliedly accepts the assignment or subletting. The lessor's receipt of rent directly from the assignee or sublessee without expressing any reservation concerning his rights against the original lessee shall constitute implied acceptance. تبرأ ذمة المستأجر الأصلي قبل المؤجر, سواء فيما يتعلق بضمان المتنازل له في حالة
التنازل عن الإيجار أو فيما يتعلق بما يفرضه عقد الإيجار الأصلي من التزامات في
حالة الإيجار من الباطن, إذا صدر من المؤجر قبول صريح أو ضمني بالتنازل عن
الإيجار أو بالإيجار من الباطن. ويعتبر قبولا ضمنيا قبض المؤجر الأجرة مباشرة
من المتنازل له أو من المستأجر من الباطن دون إبداء إي تحفظ في شأن حقوقه قبل
المستأجر الأصلي.
