١ - إذا كانت الوكالة بلا أجر, وجب على الوكيل أن يبذل في تنفيذها العناية التي
يبذلها في أعماله الخاصة, دون أن يكلف في ذلك أزيد من عناية الشخص العادي.
٢ - فإن كانت بأجر وجب على الوكيل أن يبذل دائما في تنفيذها عناية الشخص
