Article 792 of Civil Code

1 - If the risks insured against increase, whether through the act of the insured or otherwise, the insurer may request termination of the contract, unless the insured accepts an increase in the insurance consideration proportionate to Law Index 1046 Home Page Civil Code Decree-Law No. 67 of 1980 AD Promulgating the Civil Code the increase that has occurred in the risk. 2 - Nevertheless, the insurer may not invoke the increase in risks if, after learning of it by any means, he has manifested his wish to retain the contract, or, in particular, if he has continued to collect the premiums or paid compensation after the occurrence of the risk insured against. - The provisions of this article shall not apply to life insurance.
