Article 51 of Law of Evidence

A person who fears losing the opportunity to adduce the testimony of a witness concerning a matter not yet brought before the courts but likely to be brought before them may request, in proceedings against the persons concerned, that this witness be heard. This application shall be submitted by the usual procedures to the judge of urgent matters, and all its expenses shall be borne by the applicant. Where necessity is established, the judge shall order that the witness be heard whenever the fact is one that may be proved by witness testimony. The judge may hear rebuttal witnesses at the request of the opposing litigant to the extent required by the circumstances of urgency in the case. In all other respects, the rules and procedures previously mentioned in the preceding Articles shall be followed in taking testimony. In this case, no copy of the record of the evidentiary examination may be delivered, nor may it be submitted to the courts, unless the court hearing the merits considers, when examining it, that the fact may be proved by witness testimony. The litigant shall have the right to object before that court to the admissibility of this evidence and shall also have the right to request that rebuttal witnesses be heard on his behalf.
