English translation
If it becomes apparent that the accused, after his referral to a forensic physician, is insane, mentally deficient, or suffering from a mental illness that renders him incapable of defending himself, the court, or the investigator during the preliminary investigation, shall order a stay of the proceedings until the accused regains his reason and is able to defend himself. However, if it becomes apparent to the court that the insanity preceded or coincided with the commission of the offence and results in the absence of the accused's responsibility, it shall determine the case without the need to stay it. It may also acquit in the case for any reason if the ground for acquittal is apparent to the court without the need for the accused's defence. In all cases, it may refer the accused to the administrative authority for placement in the institution designated for mental illnesses, or hand him over to one of his relatives for his safekeeping and care, and order that he be held under restraint in the manner it deems appropriate.

Ask about this article
