English translation
If the victim of the crime has limited legal capacity or is absent, his lawful guardian may act on his behalf in reaching a settlement with the accused or pardoning him. If the person of limited legal capacity or the absent person has no lawful guardian, the court before which the action is brought may, upon an application submitted by an interested person, issue authorization to one of the relatives of the victim or the defendant or to the Public Prosecutor to act on his behalf in exercising the right of settlement. إذا كان المجني عليه في الجريمة ناقص الأهلية أو غائبا، فلوليه الشرعي ان ينــوب
عنه في الصلح مع المتهم أو في العفو عنه.
وإذا لم يكن لناقص الأهلية أو الغائب ولي شرعي، فإن للمحكمة المرفوع لها الدعوى،
بناء على طلب يتقدم به من له مصلحة، ان يصدر إذنا لأحد أقارب المجني عليه
أو المدعي عليه أو النائب العام بأن ينوب عنه في مباشرة حق الصلح.
