English translation
The High Court of Appeal may issue a decision restoring the convicted person's legal standing upon his application, provided that the following conditions are met: 1 - The sentence imposed has been executed, pardoned, or extinguished by limitation. 2 - Five years have elapsed from the date of completion of execution, issuance of the pardon, or expiry of the limitation period in respect of a sentence exceeding imprisonment for three years and a fine of 225 dinars, and three years in respect of a sentence not exceeding that. - The convicted person's conduct has improved. يجوز لمحكمة الاستئناف العليا ان تصدر قرارا برد الاعتبار إلى المحكوم عليه بناء
على طلبه، متى توافرت الشروط الآتية:
۱ - ان تكون العقوبة المحكوم بها قد نفذت أو صدر عفو عنها أو سقطت بالتقادم.
٢ - ان يكون قد مضى من تاريخ تمام التنفيذ أو صدور العفو أو انقضاء مدة التقادم
خمس سنوات بالنسبة إلى العقوبة التي تزيد على الحبس لمدة ثلاث سنوات والغرامة
بمبلغ ٢٢٥ دينار، وثلاث سنوات بالنسبة إلى العقوبة التي لا تزيد على ذلك.
