Article 27 of Code of Criminal Procedure and Trials

An independent application for a preventive order shall be submitted to the court in accordance with the ordinary procedures for instituting proceedings, and the Public Prosecutor shall submit with it the preliminary inquiry papers supporting it. The court must hear the statements of the Public Prosecution and the defendant and undertake the procedures necessary to examine the defendant's defense before granting the application. The court may reject the application without investigation if, upon reviewing the preliminary inquiries submitted to it, it finds that the undertaking is unnecessary.
