English translation
The Chief of Police and Public Security may request the Public Prosecution to submit a separate application to the Criminal Court to obtain an order for one of the preventive measures provided for in Article 24 against a person whose conduct and tendencies are established to his satisfaction as portending the commission of crimes, if any of the following conditions is met: 1- He has previously been sentenced to imprisonment for one year or a more severe penalty for any crime. 1( Added pursuant to Decree-Law No. 104 of 2024 2- He has been seriously accused of committing an offence against the person or property but has not been sentenced or proceedings have not been brought against him owing to insufficient evidence. 3- He is known by general reputation habitually to commit offences against the person or property. 4- He has no occupation or work and no lawful means of livelihood, or is known by general reputation to earn money by unlawful means.

لرئيــس الشرطــة والامــن العــام ان يطلــب مــن النيابــة العامــة تقديــم طلــب مســتقل الى
محكمــة الجنايــات لاســتصدار امــر بأحــد الاجــراءات الوقائيــة المنصــوص عليهــا في المادة
24 ضــد الشــخص الــذي يثبــت لديــه ان في ســلوكه وفي ميوله مــا ينذر بارتــكاب الجرائم
إذا توافــر أحــد الشروط الآتيــة :
١- ان يكــون قــد ســبق الحكــم عليــه بعقوبــة الحبــس مــدة ســنة أو بأشــد مــن ذلــك في أيــة
جريمة.
2- ان يكــون قــد اتهــم جديــا بارتــكاب احــدى جرائــم الاعتــداء على النفــس او على المال
ولكــن لم يحكــم عليــه بالعقوبــة او لم ترفــع عليــه الدعــوى لعــدم كفايــة الادلــة.
3- أن يكــون معلومــا عنــه بالشــهرة العامــة اعتيــاده على ارتــكاب جرائــم الاعتــداء على
النفــس او على المال.
4- إذا لم يكــن صاحــب مهنــة او عمــل وليســت لديــه مــوارد مشروعــة للعيــش او كان
قــد عــرف عنــه بالشــهرة العامــة كســب المال بوســائل غير مشروعــة.Ask about this article
