يجوز للمحكمة ان تستعمل السلطة المخولة لها في المادة السابقة في حالة ما إذا اصدرت
الحكم بالبراءة في الدعوى الاصلية، وذلك إذا وجدت ان ظروف الحال تستلزم اتخاذ
