Article 252 of Personal Status Law

a. If a bequest is made to one person of an undivided share in the estate and to another of the equivalent of the share of a specified or unspecified heir, a portion equal to the heir's share shall first be calculated for him on the assumption that there is no other bequest. The one-third shall be divided proportionately between the two bequests if it is insufficient for both. b. If the bequest is of a specified amount of money or a particular asset of the estate instead of an undivided Law Index 1165 Home Page Personal Status Law Law No. 51 of 1984 concerning Personal Status share, the money or the value of the asset shall be assessed in terms of its equivalent in shares of the estate.
