Article 276 of Personal Status Law

English translation

a- In a bequest of a periodic payment from capital, the legatee shall receive his periodic payment from the yield of the asset allocated to the bequest. If the yield is insufficient for the payment, the heirs may make up the shortfall; otherwise, enough of that asset shall be sold to meet the payment. If the yield exceeds the periodic payment, the surplus shall be returned to the testator’s heirs. b- In a bequest of a periodic payment from yield, the payment shall be satisfied from the yield of what has been allocated to the bequest. If the yield in some years exceeds the periodic payment, it shall not be returned to the testator’s heirs but shall be retained to cover shortfalls in yield in some years. c If the will stipulates that the periodic payment shall be satisfied year by year, or an indication establishes that, the annual surplus shall be returned to the testator’s heirs.
