English translation
The issuance of a decision opening bankruptcy declaration proceedings shall cause all monetary debts owed by the debtor to become immediately due, whether they are ordinary debts or debts secured by a general or special preferential right. Accrual of interest on ordinary debts shall also be suspended in relation to creditors only. Interest on debts secured by a mortgage or preferential right may be claimed only from the proceeds of sale of the property securing those debts. The principal debt shall be deducted first, then interest due before the issuance of a decision opening bankruptcy declaration proceedings, then interest due after its issuance. يترتب على صدور قرار بافتتاح إجراءات شهر الإفلاس سقوط آجال جميع الديون
النقدية التي على المدين، سواء كانت ديوناً عادية أو كانت ديونا مضمونة بامتياز
عام أو خاص، كما يوقف سريان فوائد الديون العادية بالنسبة إلى الدائنين فقط .
ولا تجوز المطالبة بفوائد الديون المضمونة برهن أو امتياز إلا من المبالغ الناتجة من
بيع الأموال الضامنة لهذه الديون، ويستنزل أصل الدين أولاً، ثم الفوائد المستحقة
قبل صدور قرار بافتتاح إجراءات شهر الإفلاس، ثم الفوائد المستحقة بعد صدوره.
وإذا كانت الديون مقومة بغير الدينار الكويتي، وجب تحويلها إلى الدينار الكويتي
