English translation
If the application for composition is submitted by the trustee, he must attach thereto a report including the status of the bankruptcy, the procedures taken in respect thereof, evidence that he presented the terms of the composition to the debtor and granted him a period of at least ten days to express his opinion thereon, whether or not the debtor expressed his opinion on the terms of the composition, and the trustee’s comments on the debtor’s opinion. If the application is submitted by the debtor, he must notify the trustee of the terms of the composition before submitting the application and request that he provide him with his opinion thereon, as well as a report on the status of the bankruptcy and the procedures taken in respect thereof. The trustee shall provide the debtor with what is requested within ten days from the date of his notification. The debtor shall indicate in the application evidence that he has taken these procedures, and shall also state the observations he received from the trustee and his comments thereon, and attach to the application the report sent by the trustee, in the event that the trustee has replied to the debtor.

إذا كان طلب الصلح مقدماً من الأمين فعليه أن يرفق به تقريراً مشتملاً عن حالة
التفليسة، وما تم بشأنها من إجراءات، وما يفيد قيامه بعرض شروط الصلح على
المدين ومنحه مهلة عشرة أيام على الأقل لإبداء رأيه بشأنه، وما إذا كان المديـن قـد
أبدى رأيه في شروط الصلح من عدمه، وتعليق الأمين على رأي المدين.
وإذا كان الطلب مقدما من المدين، فيجب عليه أن يخطر الأمين بشروط الصلح قبل
تقديم الطلب، ويطلب منه تزويده برأيه فيها وكذلك تزويده بتقرير عن حالة
التفليسة وما تم بشأنها من إجراءات، وعلى الأمين أن يزود المدين بالمطلوب خلال
عشرة أيام من تاريخ إخطاره، وعلى المدين أن يبين بالطلـب مــا يفيد اتخاذه هذه
الإجراءات، كما يبين ما تلقاه من ملاحظات من الأمين وتعليقه عليها، ويرفق
بالطلب التقرير المرسل من الأمين وذلك في حالة أن يكون الأمين قد رد على المدين.Ask about this article
