Article 41 of Bankruptcy Law

In cases where the trustee is entrusted with managing the debtor’s assets and business, the trustee shall preserve those assets and represent the debtor in all acts required for managing his assets and business. If the debtor is a company, the trustee shall have the same powers prescribed in the company’s constitutive contract for the board of directors, the chairman of the board, the chief executive officer and the company manager. If certain management acts or certain transactions specific to the company require the approval of Law Index 1396 Home Page Bankruptcy Law Law No. 71 of 2020 Promulgating the Bankruptcy Law the partners’ meeting or the company’s ordinary or extraordinary general meeting, the Bankruptcy Committee shall replace them in issuing that approval.
