Article 83 of Bankruptcy Law

The preventive settlement proposal shall satisfy the standards of fairness if the following are met: (1) The creditors receive adequate information and sufficient time to study the preventive settlement proposal. (2) There is no breach of the creditors' meeting and voting procedures contained in the preventive settlement proposal presented to the Bankruptcy Department before the commencement of preventive settlement proceedings. (3) The existing rights of creditors—particularly the rights of creditors holding security rights and preferential rights—are respected, and holders of rights of equal rank are treated equally, particularly with regard to sharing losses and distributing new rights.
