Article 21 of Municipality Law

Within the framework of the State's general structural plan and the approved budget, the Municipal Council shall have jurisdiction over the following matters: 1 - Approval of regulations relating to municipal activities and services and regulations governing the work of the Municipal Council in accordance with the powers assigned to it under this Law, and in particular the following regulations: a - Regulation of construction work. Building regulations governing investment and commercial properties and the like must include special conditions for providing the full required number of parking spaces within their boundaries, calculated according to the activities and uses established in those properties. b - Regulation of professional practice by local engineering offices and firms relating to construction affairs. c - Public residential cleanliness in accordance with the powers assigned to the Municipality. d - Occupation of public roads, squares, pavements and open spaces. e - Planting of State-owned open spaces adjoining private and model residential houses. f - Erection of parking shelters for private and model housing and government and private entities. (1) The last paragraph is repealed pursuant to Decree-Law No. 59 of 2026 Law Index 265 Home Page Municipality Law Law No. 33 of 2016 concerning Kuwait Municipality g - Regulation of funeral procedures, transport of the dead and burial, and supervision of cemeteries. h - Rules concerning ownership, usufruct and easement rights over land and private roads carved out of properties, whether such roads are through roads or dead ends, in a manner not inconsistent with the laws. i - Rules concerning determination of property disputes between the Municipality and interested parties regarding excesses or shortfalls in properties and land relative to the contents of their official ownership documents, or their overlap with State property. j - Classification, licensing and monitoring of construction and demolition contractors. k - Imposition of fees in consideration of municipal services or use of municipal facilities, or their amendment or abolition. l - Organization of the work of the Municipal Council. m - Public markets, except markets for birds, poultry, live animals and ornamental fish. n - Public premises and premises disturbing the peace. The competent Minister shall issue the regulations referred to in item (1) after their approval by the Municipal Council. 2 - Monitoring implementation of laws and regulations relating to municipal affairs in accordance with the provisions of this Law. 3 - Proposal of regulations for the subdivision and amalgamation of planned plots of all types, preparatory to their issuance by decree. 4 - Determination of projects and their locations from an urban-planning perspective, and the beautification and expansion of cities, villages, suburbs, areas, islands, roads, streets and squares. e - Determination of public benefit in accordance with the arrangements prescribed by the provisions of the Law on Expropriation and Temporary Appropriation for Public Benefit. 6 - Determination of the establishment of cities, villages, suburbs, areas, islands, roads, streets, squares, markets, slaughterhouses, cemeteries and others. - Giving an opinion in advance on every concession or monopoly whose subject is the operation of a public utility within the Municipality's jurisdiction. - Discussion of the Municipality's draft budget for the new financial year and the draft final account for the financial year ended. 9 - Consideration of proposals submitted concerning any municipal matter, and issuance of its decisions or recommendations thereon. 10 - Determination of area plans and designation of land uses, and creation and organization of residential, investment, commercial, industrial and other areas, consistently with the State's general structural plan. 11 - Giving an opinion on the draft general structural plan of the State, preparatory to its issuance by decree. Law Index 266 Home Page Municipality Law Law No. 33 of 2016 concerning Kuwait Municipality 12 - Determination of the planning and distribution of planning blocks and the annexation and excision of pockets and surplus areas resulting from planning, and approval of projects for the division and subdivision of land intended for construction, in accordance with the arrangements and procedures specified by the Municipal Council. 13 - Acceptance of unconditional donations for municipal activities after approval by the Council of Ministers. 14 - Proposal of regulations on safety systems for individuals, property, public facilities and public wealth resources, preparatory to their issuance by decree, in accordance with the provisions of the aforementioned Decree-Law No. (18) of 1978. 15 - Naming of cities, suburbs and areas. Roads, streets and squares may be named after persons in accordance with the controls and rules established by the Council of Ministers. When approving the offering of projects on State real property, the Municipal Council must comply with the provisions of the aforementioned Decree-Law No. (105) of 1980 and Law No. (116) of 2014.
