Article 33 of Municipality Law

The executive apparatus is prohibited from granting building permits for investment and commercial buildings unless the building includes a basement or a floor covering the entire area of the building, consisting of one or more storeys as needed, allocated for vehicle parking. The number of storeys and parking spaces shall be determined in accordance with building rules and regulations. The executive apparatus is also prohibited from issuing a building description certificate and survey and demarcation letters for properties in violation of the applicable building regulations. No violating property may be exempted from the provision of this Article. In all cases, when judgments ordering the sale of property by public auction are issued, the announcement inviting participation in the auction sale proceedings shall expressly provide a clear statement of any violations attaching to the property offered for sale or obligations encumbering it. Procedures awarding the auction without this stipulation shall be void, with the effects resulting from that nullity. For the purposes of applying the provisions of this paragraph, a building description certificate Law Index 270 Home Page Municipality Law Law No. 33 of 2016 concerning Kuwait Municipality and survey and demarcation letters may be issued for violating properties offered for sale by public auction in accordance with the conditions and controls specified by the Executive Regulations of this Law.
