Article 38 of Municipality Law

Without prejudice to any more severe penalty provided for in another law, the decrees and regulations referred to in this Law shall specify the penalties imposed on anyone who violates their provisions as a fine of not less than one hundred Kuwaiti dinars and not more than five thousand Kuwaiti dinars. The aforementioned decrees and regulations may also include, in addition to the fine, the penalty of temporary or permanent closure, suspension of the licence for a specified period or its permanent withdrawal, and correction of the offending works, demolition, restoration and reinstatement to the original condition, as the case may be. As an exception to the penalties provided for in the preceding paragraphs, and without prejudice to any more severe penalty provided for in another law, anyone who erects a building without a licence, exceeds the licensed number of floors, exceeds the building area licensed to him, or uses the building for a purpose other than that designated for it shall be punished by a fine of not less than one thousand Kuwaiti dinars and not more than five thousand dinars, together with removal of the violation and reinstatement to the original condition, for each square metre of construction or use contrary to the applicable regulations in investment, commercial, industrial, craft and service buildings. Home Page Law Index 271 Municipality Law Law No. 33 of 2016 concerning Kuwait Municipality The fine shall not be less than fifty Kuwaiti dinars and shall not exceed five hundred Kuwaiti dinars, together with removal of the violation and reinstatement to the original condition, for each square metre of construction or use contrary to the applicable regulations in private and model housing buildings and those treated as such. In all cases, the person concerned shall be required to remove the violation at his own expense if he does not rectify his offending situation in accordance with the regulations in force and within the period specified by the Municipality. The building regulations may include, in addition to the two penalties of a fine and removal and reinstatement to the original condition, the penalty of temporary or permanent closure and permanent withdrawal of the licence or its suspension for a specified period.
