Article 39 of Municipality Law

Subject to the provisions of Article (38) of this Law, and without prejudice to any more severe penalty stipulated in this Law or any other law, any owner of an engineering consultancy office or firm, engineer, supervisor or contractor whose responsibility is established for erecting buildings without a permit, supervising their construction, or any other building violations shall be punished by a fine of not less than five thousand Kuwaiti dinars and not more than ten thousand Kuwaiti dinars, together with withdrawal of the engineering office's licence, suspension of the contractor's classification, and administrative deportation from the country of a non-Kuwaiti violator. Both the contractor and the engineer supervising the execution of building works shall also be punished by imprisonment for a term of not less than one year and not more than seven years if execution is carried out fraudulently and this leads to the total or partial destruction of the building. The penalty shall be imprisonment for a term of not less than two years and not more than fifteen years if this leads to loss of life.
