The insured person may request that his retirement pension be calculated on the basis of dividing his contribution period counted under this insurance into two separate periods, the first of which shall be no less than fifteen years, if this would increase the pension payable to him, provided that service with the last employer in the first period is no less than two years, unless that period was spent in the government sector. Periods added to the contribution period under this insurance shall be counted with the period in which they were added, unless they constitute a period of actual service, in which case they shall be counted with the period in which they fall or the period immediately following it. The period added pursuant to Article (17) of this Law shall be included in the second period. The portion of the pension payable for the first period shall be calculated at the rate of (65) of the last monthly salary therein for fifteen years thereof, increased at the rate of (2) for each additional year. The portion of the pension payable for the second period shall be calculated at the rate of (2) of the last monthly salary therein for each year thereof, such that the total of the two periods does not thereby exceed thirty years. The provision of the preceding Article shall be observed in determining the last monthly salary in each period separately. Any of the beneficiaries of the insured person may request calculation of the pension in accordance with the provisions stipulated in this Article. For the purposes of applying the provisions of this Article, retirement pension means the total pensions, shares and increases payable, regardless of the basis on which they are granted, their designation or the entity bearing their cost. A decision issued by the Minister following the approval of the Board of Directors shall determine the minimum retirement pension in other cases. The decision shall also determine the rules and conditions of dependency and the consequences of a change in the pensioner's social status in terms of continuing payment of the amount of the increase to the minimum or adjusting it. The minimum retirement pensions may be increased by a decision issued by the Minister following the approval of the Board of Directors.
