Article 42 of Social Insurance Law

If the injury results in total disability or the death of the insured person, he shall be entitled to an injury pension equivalent to 95% of the salary specified in Article 19 of this Law at the time the injury occurred. If the injury results in partial disability, the insured person shall be entitled to an injury pension assessed as a proportion of the total disability pension referred to in the preceding paragraph equal to the percentage of partial disability. A decision of the Minister shall specify the injury pensions in lieu of which the Institution may pay their capital value and the conditions and rules relating thereto. The capital value shall not be paid until the disability has been definitively established.
