Article 43 of Social Insurance Law

If the insured person has previously sustained an occupational injury, the following shall be taken into account in calculating his injury pension: 1 - If the Institution has previously paid the capital value of the pension due for his injury or previous injuries, or if the injury or injuries occurred on a date prior to participation in the insurance, the injured person shall be entitled, for his latest injury, to a pension based on the percentage of disability resulting from that injury alone and his salary at that time. 2 - If the insured person has previously become entitled to an injury pension, his pension shall be assessed either on the basis of the percentage of disability resulting from all his injuries and his salary at the time of the latest injury, or on the basis of the percentage of disability resulting from the latest injury alone, with the previous injury pension added thereto, whichever is more advantageous to the insured person, provided that the amount he receives does not exceed the total disability pension stipulated in the preceding Article.
