Article 58 of Social Insurance Law

Subject to the conditions, rules and limits prescribed by a decision of the Minister after the approval of the Board of Directors, a period of previous service or activity or notional contribution periods may be included in the contribution period under this insurance. Chapter Two Entitlement to a Pension Article 59 (1) A retirement pension shall be payable in the following cases: 1 – The death or total disability of the insured person before the end of contributions or within a period not exceeding two years from the date they ended, where that person was not subject to the provisions of Part Three of this Law or the provisions of Military Retirement Pensions and Gratuities Law No. (69) of 1980. In these circumstances, the pension shall be calculated on the basis of the contribution period credited under this insurance or fifteen years, whichever is greater. In the event of death or total disability before the end of contributions, the remaining period until the insured person would hypothetically reach the age of sixty shall be added to the insurance contribution period. Where entitlement to the retirement pension arises after the end of service, any retirement gratuity paid shall be recovered pursuant to Article (17) of this Law. 2 - The insured person reaching the age of sixty when the contribution period credited under this insurance amounts to fifteen years. ) - The insured person reaching the age of fifty-five when the contribution period credited under this insurance amounts to twenty years. ) Entitlement to the pension pursuant to clauses (2) and 3 ) shall be upon the insured person's request. 4 When the insured person ceases to carry on their activity.
