As an exception to the provision of Article 10 of this Law, the financial position of the commutation scheme shall be examined separately at least once every six years by an actuary appointed by the Board of Directors. If the examination reveals a surplus, it may be distributed to those who have commuted their pensions in accordance with what the Board decides. If, however, the examination reveals a deficit, the actuary must explain the reason for this deficit and the means sufficient to remedy it.
