Article 189 of Commercial Code

1 - The carrier guarantees passengers' safety during performance of the contract of carriage and shall be liable for bodily or material damage sustained by the passenger and for delay. It may disclaim liability only by proving force majeure or the passenger's fault. 2 - The heirs shall have the right to claim compensation from the carrier for the damage sustained by their predecessor, whether death occurred immediately following the accident or after a period of time.
