Article 268 of Commercial Code

1 - The agent's preferential right shall take precedence over all other preferential rights except judicial expenses and amounts due to the Government. 2 - Enforcement against the goods and things in the agent's possession to satisfy his claim shall follow the procedures for enforcement against a thing subject to a commercial pledge. Nevertheless, if the agent is entrusted with selling the goods or things in his possession, he may enforce against them to satisfy his claim by selling them without needing to follow the aforementioned procedures, unless he is unable to carry out the principal's instructions concerning the sale.
