Article 514 of Commercial Code

1 - A cheque may not be issued unless, at the time it is drawn, the drawer has funds with the drawee which he may dispose of by cheque pursuant to an express or implied agreement. 2 - The drawer of the cheque, or the person ordering another to draw it for his account, shall provide funds for its payment. Nevertheless, a drawer for another's account shall remain personally liable to the endorsers and holder, but not to others. 3 - The drawer alone must prove, in the event of denial, that the person on whom the cheque was drawn held funds for its payment at the time it was drawn. If he fails to prove this, he shall guarantee its payment even if the protest was made after the specified time limits.
